Terms of Use – Online Payment Gateway
Kindly read these terms and conditions carefully.
- Scope
1.1 These online payment terms and conditions (Terms) apply to the User who uses the Online payment transaction service (the Service) provided for any payment made to the Council of Legal Education, Norman Manley Law School (NMLS).
- User Acceptance of Payment Gateway Terms of Use
2.1. The User may use the Service for the purpose of making payments to NMLS only, via online transactions, provided that the User does not:
2.1.1 In any way damage or disrupt the Service and / or the operation of the Service
2.1.2 Use the Service for any unauthorised or unlawful purpose
2.2 .By authorising a payment to NMLS through the Service it would be treated as a deemed acceptance of these terms and conditions.
2.3. Before using this Service, it is recommended that the user should make the necessary enquiry about the charges or fees payable against the Credit/Debit card used from Credit Card or the Debit Card service provider i.e. the respective Bank.
2.4. NMLS reserves all the right to amend these terms and conditions at any time without giving prior notice.
2.5. It is the responsibility of the User to have read the terms and conditions before using the Service.
3. Payment
3.1 The User may pay tuition fees/ ancillary fees to NMLS by using a debit/ credit card or through an online banking account.
3.2. The User warrants, agrees, and confirms that when he/ she initiates a payment transaction and/or issues an online payment instruction and provides his/ her card/bank details:
- The User is fully and lawfully entitled to use such credit/debit card bank account for such transactions;
- The User is responsible to ensure that the card/ bank account details provided by him/ her are accurate;
- The User authorises debit of the nominated card/ bank account for the payment of fees selected by the User together with the applicable Fees.
- The User is responsible to ensure that sufficient credit is available on the nominated card/ bank account at the time of making the payment to permit the Payment of the dues payable or fees dues selected by the Applicant inclusive of the applicable Fee.
3.3. No warranty, representation or guarantee, express or implied, is given by the NMLS in respect of the operation of the service.
3.4. NMLS is not directly involved in the online payment which is provided through a third party service provider.
3.5. The credit card information supplied at the time of using the service is processed by the service provider’s payment gateway and is not supplied to NMLS.
3.6.. It is the sole responsibility of the User of the service to ensure that the information entered in the relevant fields is correct.
4.Privacy and use of information
4.1. NMLS will comply with the Data Protection Act in relation to any applicable information which is supplied to NMLS.
4.2. Information provided by the user on this website shall be kept confidential and shall not be shared with anyone. The DATA will neither be made accessible to third parties nor transferred in any form or manner unless required in accordance with the Data Protection Act.
4.3. NMLS may share personal information provided during the transaction with our bankers for clearing necessary fee payments. This information shall be strictly in accordance with the Data Protection Act 2020.
4.4. The purpose of an online fee payment system is to provide flexibility to students by offering them the option to pay online using various payment methods.
4.5. It is the sole responsibility of the student to choose an online payment option. NMLS does not recommend/ prefer/promote any particular method.
5.NMLS Limitation of Liability
NMLS shall not be liable for any inaccuracy, error or delay in or omission of:
(a) any data, information or message, or
(b) the transmission or delivery of any such data, information or message or
(c) any loss or damage arising from or occasioned by any such inaccuracy, error, delay or omission, nonperformance or interruption in any such data, information or message. .
6.Governing Law:
These terms and conditions are governed by the laws of Jamaica
7.Dispute Resolution:
Any dispute arising in relation to the terms and conditions will be submitted for mediation by NMLS.
8.Refund/Cancellation Policy:
Fees, once paid, will not only be refunded in accordance with the refund policy.
9.Security
All payment details which are entered through this payment gateway are encrypted when the Student or third party making payment enters them. The site is secure and uses 128-bit encryption to offer secure communications by encrypting all data to and from the site. The NMLS shall not be liable for any failure by the student or third party making payment of Fees to properly protect data from being seen on their screen by other persons or otherwise obtained by such other persons during the Online Payment processes or in respect of any omission to provide accurate information in the course of the Online Payment Process.
- Variations to the Terms and Conditions:
The NMLS reserves the right to vary these Terms and Conditions from time to time, and the current version will be published on this website. We reserve the right to decline the acceptance of an online payment if the account is in default for any reason. NMLS may also make additions/deletions/alterations to the services offered at its sole discretion. The school reserves the right to withdraw the service at any time at its discretion. We retain the right to change the terms and conditions for Online Fees Payments without any prior notice.
